LEGAL ASSISTANCE IN UKRAINE

Property and the rights to it

We establish what the property is and what it is worth, search for it, accompany transactions, division and use, and claims for money and for property held without permission.

A flat, a car, equipment, a business, a share, stock, a licence, a site, or a partners’ agreement. Land is formalised under Land.

What the work covers

The property and its value

We establish what belongs to you, and we organise the valuation. The value is set by a valuer of the required qualification. A valuation report and a court expert’s opinion are different documents. The court assesses the evidence. The parties agree the price of a future transaction themselves.

A search for property that is yours

We search for your property, not an inheritance, including abroad, and only from lawful sources. Geography and sources are agreed before the work starts. What is found is not itself a right, and it is not an instruction to sell.

Transactions before a dispute

We accompany a purchase, a sale, a gift, and a transfer while there is no dispute: a marital agreement, an agreement of co-owners, a corporate agreement, a development contract.

Division and use

Division of the property, allocation of a share in kind, and an order for use are different remedies. An agreement dividing immovable property is notarised. The corporate block is conducted with a lawyer engaged for that matter.

Money and debts

We prepare a demand when you are owed, or a sum is claimed from you: a loan, work, an advance. The sum, the currency, the time, and proof that the money was handed over are fixed before a demand. The deliverable is a demand, negotiations, or a claim through an advocate.

Holding and use without permission

We prepare a demand when property, access, or rights are used without permission: code, a domain, text, a photograph, a mark, stock written off, unpaid dividends. Negotiations and a demand come first. Court representation is by an engaged advocate.

QUESTIONS & ANSWERS

On the property.

Who states what the property is worth?

The value is stated by a valuer of the required qualification. A valuation report and a court expert’s opinion are different documents. The court assesses the evidence. The parties agree the price of a deal.

Is property that has been found already a right?

No. The search uses lawful sources only. The geography and the sources are agreed before it starts. What is found is not itself a right, and it is not an instruction to sell the property.

Are division, allocation, and use the same thing?

No. Division of the property, allocation of a share in kind, and an order for use are different. A notary certifies an agreement to divide immovable property.

Which property of a married couple is common?

Property acquired during the marriage is their common joint property. What each owned before the marriage, what was received as a gift or by inheritance, and things for personal use stay personal. The shares in the common property are equal, unless an agreement or a court has set something else.

We lived as one family without a marriage.

Property acquired during that cohabitation is common joint property if they are not married to each other, neither is married to anyone else, and a written contract has not set something else. A division has to prove the family itself and that the particular thing was acquired in that period. What was acquired before the cohabitation, with personal funds, as a gift, or by inheritance is not divided.

Money is owed to you, or a debt is claimed from you.

Before the demand, the sum, the currency, the term, and proof that the money was handed over are fixed. Then comes the demand, negotiation, or a claim. In court the advocate engaged for the matter appears.

Property or a right is used without permission.

Code, a domain, text, a photograph, a mark, shares that were written off, dividends that were not paid. First negotiation and a demand. Court representation is by the advocate engaged for the matter.

A share in a company.

An exit, a buy-out, dividends, and shares are handled with a lawyer engaged for that matter. Land in the transaction is handled on the Land page.
