LEGAL ASSISTANCE IN UKRAINE

Land plots and the rights to them

A check of the plot, formalising the right, the cadastre, transactions, disputes.

The property list and the land list are not one open-ended package: the subject, the stages, the specialists and the cost are fixed in the contract before the work starts. For private owners, heirs, land users and businesses.

What the work covers

Check the plot

A consultation and a legal check of the plot: the documents, the registered rights, the encumbrances, the designated use and the limits on use, the status of the title papers, and what has to be done to bring them into line. The result is a written conclusion on the risks and a plan of action. The conclusion does not replace an extract and is not a permit to build.

Formalise or restore title

Formalising or restoring ownership or use, including the land under the client’s building.

Buy, sell, let, use

Purchase, sale, gift and other transactions, with a check of the limits and the rights of first refusal, and the land right that passes when a building is bought.

A dispute over the plot

Boundaries, self-seizure, access, co-owners, spouses, heirs, a tenant, or an unlawful transfer. The work is negotiations, a claim, or a court through an advocate.

An enterprise’s land

Applications to public authorities and auctions of state or municipal land. Project or continuing support is named in the contract: which plots, which decisions, and for how long.

A land share

The certificate, a lease, allocation in kind, a share left by a relative. If a relative left the share, the inheritance is formalised under Inheritance, and this work starts once the share is known.

Formalise or restore title

  • Privatisation is taken only where the law allows it for this plot.
  • The cadastre: enter the plot, correct errors of area, coordinates and boundaries, and challenge an unlawful decision, act or failure of the registrar.
  • Land management and surveying are done by instructed contractors with certified engineers. Dublon organises the process and stays with it so the papers match the legal grounds.
  • Division, merger and use of shared land, including an allocation in kind where that is legally and technically possible. We accompany the notarial agreement that divides the plots.

Buy, sell, let, use

  • Lease and other rights of use: the land payment, reliefs and rates, recovery of a plot that was transferred unlawfully, a servitude, emphyteusis, superficies.
  • A change of designated use is accompanied only after we have assessed whether the law allows it for this plot, and together with the local planning documents.
  • A valuation is organised through a valuer — for a sale, a division, an inheritance or a court case — and is challenged where there are grounds.

QUESTIONS & ANSWERS

On the plot.

What does the note on a plot say?

The documents, the registered rights, the encumbrances, the designated purpose, the limits on use, and the next steps. The note does not replace an extract from the register and it is not a permit to build.

When is privatisation taken?

Only where the law allows it for that plot.

The cadastre has the area, the coordinates, or the boundary wrong.

The entry is corrected. An unlawful decision, act, or failure to act by the registrar is challenged. Land management and surveying are done by engaged firms with certified engineers. Dublon organises the work and follows it so the documents match the legal basis.

A building is bought. What happens to the land?

The person who acquires a house, other than an apartment in a block, or a building or structure, takes the right to the plot it stands on, without a change of designated purpose, in the extent and on the terms the seller held. Restrictions and rights of first refusal are checked before the deal.

Lease, servitude, emphyteusis, superficies.

A lease is paid use for a term. A servitude is a right of way, a right to drive across, or another limited use of someone else’s plot. Emphyteusis is a right to use someone else’s land for agriculture. Superficies is a right to use someone else’s land for building. None of these rights is ownership of the plot.

A change of designated purpose.

It is handled when the law allows the change for that plot, together with the local planning documents.

A dispute over a plot.

A boundary, occupation without right, access, co-owners, spouses, heirs, a tenant, or an unlawful transfer. The work is negotiation, a demand, or a court claim through an advocate.

A share of former collective land after a relative’s death.

The inheritance of that share is formalised on the Inheritance page. The work on the certificate, the lease, and allocation in kind starts when the share is already known.

State or municipal land for a company.

It is obtained by an application to the authority or by auction. The contract names the plots, the decisions, and the term.
